Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and Toasted Tanz LLC (“Toasted,” “we,” “our,” or “us”) governing access to the Toasted Tanz iOS app, artist booking pages on toastedtanz.com subdomains, and related websites (collectively, the “Services”). By creating an account, downloading the app, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you use the Services on behalf of a business, you represent that you have authority to bind that business. “You” then means that business.

Toasted provides business tools for spray tan artists, including online booking, CRM, payments (via Stripe), SMS (via Twilio), inventory, and optional Calendar Sync with Apple Calendar and/or Google Calendar. Clients of Artists book and communicate through web links and SMS; Clients are not required to download the Artist app.

We may modify, suspend, or discontinue features with reasonable notice when practicable. We do not guarantee uninterrupted or error-free operation.

• You must be 16 or older to create an Artist account
• You are responsible for account credentials and all activity under your account
• Provide accurate studio and contact information and keep it updated
• Single-User plans are for one Artist account unless we offer a multi-user plan you purchase

Paid plans are billed through Stripe Billing. Current catalog plans may include Solo (commonly $49/month), Day Ones ($29/month where offered), Friends & Family ($0 where granted), and future tiers. The price, nickname, and billing interval shown in the app, on Pricing, or at Stripe checkout / customer portal for your subscription control what you owe—not older marketing copy elsewhere.

• New accounts may include a free trial as disclosed at signup; card requirements may vary by offer
• Subscriptions renew automatically until canceled
• Cancel anytime; access generally continues through the end of the paid period, then booking closes
• No refunds for partial months unless required by law or we expressly agree in writing
• Client payment processing fees are separate and governed by our Payment Services Terms

• Canceling your subscription disables public booking and stops future SaaS billing at period end
• Account data is generally retained about 45 days after the final paid period, then purged, as described in our Privacy Policy
• Export business records you need before deletion (including consents and payment history)
• Request export via support@toastedtanz.com before account deletion
• Instant Delete Account in Settings permanently removes data subject to limited legal archives (SMS consent / agreements) described in the Privacy Policy

• You are the controller of Client personal data; Toasted processes it under our Data Processing Addendum
• Obtain and maintain lawful SMS consent before studio texts; honor STOP and applicable telemarketing laws (including TCPA)
• Do not use the Services to spam, harass, or message Clients who opted out
• See SMS Consent for how booking-page consent is presented

Calendar Sync is optional and off by default. If you enable Apple Calendar and/or Google Calendar Sync, you authorize Toasted to create, update, and remove calendar events that mirror appointments and schedule items you choose to export. Google access uses OAuth; you may disconnect in Settings or revoke access in your Google Account. You are responsible for what Client information appears in event titles on calendars you control. Calendar Sync does not replace Toasted as the system of record for bookings.

Marketing pages on toastedtanz.com may use analytics only after consent (see Privacy Policy). Booking pages on Artist subdomains collect privacy-minimized funnel metrics. Do not scrape, attack, or overload the Services. Waitlist and community features are subject to these Terms and any on-page rules.

• No unlawful, fraudulent, or infringing use
• No accessing another Artist’s data or circumventing security or billing
• No reverse-engineering, bulk scraping, or redistributing the Services except as allowed by law
• No processing payments for prohibited or restricted businesses under Stripe’s rules

Toasted and its branding, software, and content are owned by Toasted Tanz LLC or its licensors. You retain ownership of your business content and Client data. You grant us a limited license to host and process that content solely to provide the Services.

Payments (Stripe), SMS (Twilio), email (Resend), hosting (Vercel/Supabase), Apple, and Google (when you connect Calendar or allow analytics) are subject to those providers’ terms. Your use of Stripe Connect is also governed by our Payment Services Terms.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOASTED AND ITS OFFICERS, MEMBERS, AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICES IS LIMITED TO THE AMOUNTS YOU PAID TO TOASTED FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE CLAIM.

You will defend and indemnify Toasted against claims arising from your Client relationships, your SMS or marketing practices, your charges to Clients, content you upload, or your breach of these Terms, except to the extent caused by our willful misconduct.

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Exclusive venue for disputes that cannot be resolved informally is the state or federal courts located in Wyoming, unless applicable law requires otherwise. Before filing a claim, you agree to email support@toastedtanz.com and attempt good-faith resolution for 30 days.

We may update these Terms. The “Last updated” date will change when we do. Material changes may also be noted in-app or by email. Continued use after an update constitutes acceptance.
